In the first case (L0569398-01), a 55-year-old janitor slipped and fell outside his apartment building, suffering a severe ankle fracture that required surgery. While property owners are not typically responsible for natural accumulations of ice, the conditions in this case were different.

The ice formed as a result of water being directed from the building’s gutter system onto a commonly used walkway. By allowing water to drain onto the sidewalk rather than away from it, the property owner created a hazardous condition that increased the risk of injury.

In a separate case (L2022426-0001), a 59-year-old shopper sustained a serious knee injury after falling inside a grocery store. The incident occurred when a handheld shopping basket provided by the store was defective. One side of the basket was not properly secured, causing it to give way while in use. As the shopper’s items fell to the ground, he tripped and fell. Retail establishments have a responsibility to ensure that the equipment they provide to customers, including baskets and carts, is safe and properly maintained.
